Terms of Use
Important: SwingMate is a planning tool, not a safety system. Always keep a backup alarm for critical shifts and flights, and follow your employer's rosters, travel arrangements and site safety procedures.
1. About these terms
These terms are an agreement between you and Luke Uglow trading as SwingMate, ABN 86 215 349 900, Western Australia ("we", "us"). They apply to the SwingMate app and this website. By using SwingMate you agree to these terms and our Privacy Policy. If you don't agree, please don't use SwingMate.
2. Who can use SwingMate
You must be at least 16 to use SwingMate. You're responsible for keeping your device and login details secure and for activity on your account.
3. Price
SwingMate is currently free. If we add paid features in future, we'll show the price and terms clearly in the app before you buy. Purchases will be processed by the Apple App Store or Google Play under their terms, and refund requests go through them. Nothing in these terms limits your rights under the Australian Consumer Law.
4. Using SwingMate properly
You agree not to misuse SwingMate. That includes trying to access other people's data or our systems without permission, interfering with how the app works, reverse engineering it except where the law allows, or using it for anything illegal.
5. Your content
Your roster data, checklists, notes and imported maps belong to you. You give us permission to store and process them only so we can provide SwingMate to you. Only import files you have the right to use. Some employer maps and documents are confidential, so check before you import them.
6. Alarms, rosters and maps
- Alarms depend on your phone's settings. Focus or Do Not Disturb modes, low battery, software updates or the app being force-closed can stop them going off. Test your alarms and keep a backup.
- Rosters are only as accurate as the details you enter. Check them against your employer's official roster.
- Maps depend on your device's GPS and the quality of the files you import. Don't rely on SwingMate maps for navigation in safety-critical situations.
6A. Money features
The Money features help you keep track of your own pay, bills and spending. They are not financial, tax or budgeting advice, and figures are only as accurate as what you enter. Check your payslips and talk to a licensed adviser for financial advice.
7. Ask SwingMate
Ask SwingMate gives automated answers generated by AI (provided by Anthropic). The answers can be wrong or out of date. Don't rely on them for safety, medical, legal, financial or travel decisions. Confirm anything important with your employer, airline or a qualified professional. Your questions are handled as described in our Privacy Policy.
8. Your consumer rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
9. Our liability
To the extent the law allows, and subject to section 8:
- SwingMate is provided "as is", and we don't promise it will always be available or error-free;
- we're not liable for indirect or consequential loss, such as a missed shift or flight, lost wages or travel costs, caused by relying on SwingMate; and
- where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
10. Ending your use
You can stop using SwingMate and delete your account at any time in Me › Account › Delete account. We may suspend or close an account that seriously or repeatedly breaches these terms. Where reasonable, we'll tell you first and give you a chance to fix the problem.
11. Changes
We may update SwingMate and these terms. If we make a significant change to these terms, we'll tell you in the app before it takes effect. If you keep using SwingMate after that, the new terms apply.
12. App Store terms
If you downloaded SwingMate from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple. Apple is not responsible for SwingMate or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you downloaded SwingMate from Google Play, Google Play's terms also apply.
13. Governing law
These terms are governed by the laws of Western Australia, and you and we submit to the courts of Western Australia and courts that can hear appeals from them.
